1. Eligibility: Must be eighteen (18) years of age or older at the time of entry. Employees of XR,LLC as well as the spouses, parents, grandparents, and household members of each such employee, are not eligible to participate in the Giveaway. The Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.

2. Sponsor: The Giveaway is sponsored by XR, LLC, 16812 Gothard, Huntington Beach, CA 92647.

3. Administrator: The Giveaway is administered by XR, LLC, 16812 Gothard, Huntington Beach, CA 92647.

4. Agreement to Official Rules: By participating in the Giveaway, entrant warrants that he/she fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.

5. Entry Period: Begins annually January at 12:00:00 a.m. Pacific Standard Time (PST) and ends on December 31 at 11:59:59 p.m. PST (the Entry Period). Entries that are received prior to or after the Entry Period are not entered into the drawing.

6. How to Enter - Two ways to enter:

(i) Automatic entry with purchase: You will automatically receive two (2) entries into the Giveaway when you make any purchase of retail products during the Entry Period from www.eXtremeRestraints.com, or any co-branded affiliate site.

(ii) Entry without purchase: To enter without a purchase, providing a valid name and email address and opt-in confirmation constitutes an entry. Entry with this method signs the entrant up to the XR monthly email newsletter. Entrants may choose to opt-out of the email newsletter at any time.

Limit: One "Without Purchase" entry per person and up to thirty (30) entries per person per month for the "Automatic Entry With Purchase" method of entry. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void entrant's entry.

7. Drawings:

The Giveaway consists of an Annual Drawing. For each Drawing, the Administrator will select the name of one (1) potential winner for each Prize. Winners will be selected in a random drawing of all entries received by the deadline. Entries that are not selected in a Drawing will NOT be carried over into subsequent Drawings. Winners will be drawn some time in the Month following the Entry Period and notified within seven (7) days.

For all Drawings: The Sponsor's and Administrator's decisions as to the selection of the potential winners are final. Odds of winning a prize in any drawing depend on number of eligible entries received for that drawing.

8. Requirements of Potential Winners: Each potential winner will be notified within seven (7) days of the drawing date. Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility and liability/publicity release (the Affidavit/Release) within ten (10) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant will be selected in his/her place in a random drawing of all entries received for the applicable drawing. In the event that the potential winner is a minor in his/her jurisdiction of residence, the prize will not be awarded and the potential winner will be disqualified, in which case and new potential winner will be drawn to replace the disqualified potential winner.

9. Prizes: There is one (1) Grand Prize in each drawing. Each Grand Prize consists of one (1) $1000 gift certificate to be used at wwww.eXtremeRestraints.com. There is one (1) Second Place Prize in each drawing. The Second Place Prize consists of one (1) $500 gift certificate to be used at wwww.eXtremeRestraints.com. There is one (1) Third Place Prize in each drawing. The Third Place Prize consists of one (1) $250 gift certificate to be used at wwww.eXtremeRestraints.com. The gift certificates will be issued only once to the email address that was initially provided upon entry into the drawing. It is the responsibility of the winner to provide a valid email address and have the ability to receive the emailed gift certificate.

TOTAL ANNOUNCED PRIZE VALUE PER DRAWING: $1750.

For all Prizes: Prizes are not transferable or refundable. Except as indicated above, no cash or other substitution is allowed except by the Sponsor who may substitute a prize (or component thereof) with another prize (or component thereof) of comparable or greater value, as determined by the Sponsor in its sole discretion. Potential winners of prizes may be required to provide their Social Security Number for tax reporting purposes if the winner is a US resident. Winner is responsible for all income and other taxes and for expenses not specified including tax, title and license fees and travel and transportation costs associated with collecting prize

10. Publicity: Except where prohibited, participation in the Giveaway constitutes an entrant's consent for the Sponsor and the Sponsor's designees to announce the entrant's first name, and state (or country) of residence for promotional purposes in any media without further payment or consideration.

11. Privacy: Information collected through the Giveaway is subject to the Sponsor's privacy policy, which is accessible from www.eXtremeRestraints.com.

12. General Conditions: In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's or Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the credit card used to purchase from eXtreme Restraints will be deemed to be the entrant. The authorized account holder is the natural person whose name appears on the credit card itself or billing statement. A potential winner may be required to show proof of being the authorized account holder.

13. Release and Limitations of Liability: Except where prohibited, by participating in the Giveaway, entrants agree to release and hold harmless the Sponsor, the Administrator, and their respective officers, directors, employees, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Giveaway or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt or use of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Giveaway, and in no event shall the Released Parties be liable for attorneys' fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

14. Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Orange County, California, USA. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the Giveaway, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of California.
